3. Eligibility

By using this Website, you represent and warrant that:

4.1 Talent Acquisition

We source and assess candidates for non-sales professional roles on behalf of client businesses. Our process includes profile screening, language proficiency testing, aptitude evaluation, technical assessment, and panel interviews.

4.2 Employer Alignment

We assist client businesses in defining roles, setting expectations, and onboarding offshore talent to ensure long-term fit and engagement.

4.3 Performance Support

We provide ongoing people management and performance support to both placed candidates and client businesses throughout the engagement.

4.4 Website Use

The Website is made available for the purpose of providing information about our services, accepting candidate applications via our Careers page, and enabling prospective clients to make contact with us.

5. User Obligations

When using the Website and our services, you agree to:

  • You represent that all information provided in your application is true, accurate, and not misleading
  • You acknowledge that submission of an application does not guarantee an interview, placement, or employment
  • You consent to being contacted by Brand Vantage and, where relevant, by client businesses regarding your application
  • You acknowledge that Brand Vantage acts as an intermediary and is not your employer unless a separate employment or contractor agreement has been executed
  • You agree that assessment data, including results from third-party tools such as Versant, may be stored and used for evaluation purposes in accordance with our Privacy Policy

7. Client Business Terms

If you are engaging Brand Vantage as a business client, the following additional terms apply:

  • The specific terms of your engagement, including fees, service scope, and obligations, will be set out in a separate written agreement between your business and Brand Vantage
  • You agree to use candidate information shared by Brand Vantage solely for the purposes of evaluating and engaging the relevant candidate, and not to share such information with third parties without our consent
  • You acknowledge that Brand Vantage does not guarantee the performance or suitability of any candidate, and that placement decisions rest with you as the client
  • You agree to comply with all applicable employment laws in your jurisdiction, including those relating to minimum wage, working conditions, and anti-discrimination
  • You agree not to directly solicit or engage candidates introduced by Brand Vantage outside of the agreed engagement terms, without Brand Vantage’s prior written consent

8. Intellectual Property

All content on this Website, including but not limited to text, graphics, logos, images, icons, and software, is the property of Brand Vantage Marketing Pvt. Ltd. or its licensors and is protected under applicable intellectual property laws, including the Copyright Act, 1957 (India).

You are permitted to:

  • Access and view Website content for personal, non-commercial purposes
  • Share links to our Website


You are not permitted to:

Where liability cannot be excluded under applicable law, our total liability to you will not exceed the fees paid by you to Brand Vantage in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits our liability for fraud, fraudulent misrepresentation, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

11. Third-Party Links and Services

The Website may contain links to third-party websites or integrate third-party tools and platforms (including assessment platforms). These links are provided for convenience only. Brand Vantage does not endorse, control, or accept responsibility for the content, privacy practices, or terms of any third-party websites or services.

12. Indemnification

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms will be resolved as follows:

  • The parties will first attempt to resolve the dispute through good-faith negotiation
  • If unresolved within 30 days, either party may refer the dispute to arbitration under the Arbitration and Conciliation Act, 1996 (India), with the seat of arbitration in Bengaluru, Karnataka, India
  • The arbitration will be conducted in English before a single arbitrator mutually agreed upon by the parties

Notwithstanding the above, Brand Vantage may seek urgent injunctive relief from a court of competent jurisdiction where necessary to protect its intellectual property or confidential information.

Nothing in this clause prevents you from raising a dispute with a consumer protection authority or equivalent regulatory body in your jurisdiction.

16. Compliance with Applicable Laws

Brand Vantage operates across multiple jurisdictions and is committed to compliance with applicable laws. Specific compliance considerations include:

  • India: These Terms and our services are subject to the IT Act 2000, DPDP Act 2023, Consumer Protection Act 2019, and all applicable Indian employment and corporate laws
  • Australia: Where services are provided to Australian clients or candidates, we comply with the Australian Privacy Act 1988, Fair Work Act 2009, and applicable consumer protection laws under the Australian Consumer Law
  • United States: Where applicable, we comply with relevant US federal and state employment and privacy laws
  • United Arab Emirates: Where applicable, we comply with UAE labour laws and data protection regulations in the relevant emirate

Nothing in these Terms is intended to limit or exclude any rights you may have under applicable mandatory laws in your jurisdiction.

17. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be deemed severed from these Terms, and the remaining provisions will continue in full force and effect.

18. Waiver

No failure or delay by Brand Vantage in exercising any right or remedy under these Terms will constitute a waiver of that right or remedy. A waiver will only be effective if given in writing.

19. Entire Agreement

These Terms, together with our Privacy Policy and any separate written service agreement executed between Brand Vantage and a client business, constitute the entire agreement between you and Brand Vantage with respect to your use of the Website and services, and supersede all prior agreements, representations, and understandings.
